Introduction

OnlineFirearmTraining.com is a firearms training school providing online firearms training classes. By signing up, you are entering into a binding contract with Streaming Media Management LLC, which includes these Terms, and an acknowledgement that you have read and understood them.

Changes

Occasionally, it may be necessary for us to make changes to these Terms. Whenever substantive changes are made, we will attempt to provide you with notice of the changes by sending you an email or text message.

Payments and Cancellations

Most of our training classes will be provided at a cost, and OnlineFirearmTraining.com may change the prices for these at any time. When enrolling in a training class, the price will be prominently displayed. This price will always reflect the full purchase price, including all taxes and fees. Refunds will be provided at our discretion, and charge backs will result in revocation of any issued training certificates.

Paying for a class at OnlineFirearmTraining.com requires payment handling through our payment processor service provider Stripe, and by using their service you agree to be bound by their terms and conditions which can be accessed at https://stripe.com/US/checkout/legal.

Our Content

All training classes and materials, including videos, audio, images, quizzes, etc. are the sole property of Streaming Media Management LLC. We grant you limited, non-exclusive, revocable permission to make use of this content and the OnlineFirearmTraining.com website.

This access will remain in effect until and unless terminated by you or Streaming Media Management LLC, up to 5 years after the date of payment.

You promise and agree that you are using OnlineFirearmTraining.com and the content therein for your own personal, non-commercial use and that you will not redistribute or transfer OnlineFirearmTraining.com or the content therein. The content on OnlineFirearmTraining.com is not sold or transferred to you, and Streaming Media Management LLC retains ownership of all copies. All OnlineFirearmTraining.com trademarks, service marks, trade names, logos, domain names, and any other features of the OnlineFirearmTraining.com brand are the sole property of Streaming Media Management LLC. The Terms do not grant you any rights to use any OnlineFirearmTraining.com branding for either commercial or non-commercial use that is not already given by applicable law (eg. Fair Use).

Usage

The following is not permitted for any reason whatsoever:

• Copying, redistributing, reproducing, "ripping", recording, transferring, performing or displaying to the public, broadcasting, or making available to the public any part of OnlineFirearmTraining.com or the content therein, which is not expressly permitted under the Terms or applicable law or which otherwise infringes on intellectual property rights (such as copyright);
• Reverse-engineering, decompiling, disassembling, modifying, or creating derivative works of OnlineFirearmTraining.com or the content therein, or any part thereof, except to the extent permitted by applicable law;
• Circumventing any technology used by OnlineFirearmTraining.com to protect the service or the content therein;
• Selling, renting, sublicensing, or leasing any part of OnlineFirearmTraining.com or the content therein;
• Manipulating OnlineFirearmTraining.com or the content therein by using any bot, script, or automated process.

Your password (if used) protects your user account, and you are solely responsible for keeping your password confidential and secure. You understand that you are responsible for all use (including any unauthorized use) of your username and password on OnlineFirearmTraining.com. If your username or password is lost or stolen, or if you believe there has been unauthorized access to your account by a third party, you must notify us immediately and change your password as soon as possible.

Service limitations

Streaming Media Management LLC will make reasonable efforts to keep OnlineFirearmTraining.com and the content therein operational. However, certain technical difficulties, maintenance or testing, or updates required to reflect changes in laws and regulatory requirements may, occasionally, result in temporary interruptions. You understand, and accept that Streaming Media Management LLC has no liability for interruptions to or changes in service.

Firearms Training Law

Our training classes are designed to meet or exceed the requirements of applicable firearm law. If the law changes, we will make reasonable efforts to continue to align with any new requirements and to provide access to updated training material during the period where your subscription is valid, but can not guarantee or offer refunds if we are unable to do so. If the law changes the amount of time between required training classes, you may be required to renew your training earlier than expected. Streaming Media Management LLC may, at their discretion, provide additional access to updated training to some or all users at reduced or no cost.

Collection and Use of Personal Data

OnlineFirearmTraining.com will only collect the minimum amount of your personal data as required to provide its services. This information will never be shared with any third party. We will only disclose your data with law enforcement if warranted.

The data we collect includes:

• Your email address or phone number

  Required so that we can communicate with you, handle password resets, and send you your certificate upon completion of a training class.

• Full Legal Name as it appears on your driver's license or state identification card

  Required to produce a verifiable certificate.

• Your Zip Code and/or Billing Address

  Required to process Sales Tax for your purchase.

The Validation service we provide will only disclose your name, completion data, and the name of the training class completed, and only to those that you provide with your unique validation code. We will take reasonable steps to ensure this information is secure against automated services (eg. Bots, crawlers, or scrapers).

Additionally, our payment processor may collect information required for your purchase, but OnlineFirearmTraining.com will not use or store that information, and does not have access to your payment information (eg. credit card number).

Data retention and deletion

We keep your personal data only as long as necessary to provide you with the service and for legitimate and essential business purposes, such as complying with our legal obligations, and resolving disputes.

Keeping your personal data safe

We are committed to protecting our users’ personal data. We implement appropriate technical measures to help protect the security of your personal data; however, please note that no system is ever completely secure. We have implemented various policies including encryption and limited access policies to guard against unauthorized access. If there are any breaches of this data, all affected users will be notified as quickly as possible.

OnlineFirearmTraining.com will never send commercial e-mails or text messages to our users and will only contact users when strictly necessary to provide our services, or as per legal requirement, or in these circumstances:

• Upon signup to welcome you to the service
• As a component of our service to allow you to reset your password or confirm your e-mail address or phone number
• To send you a receipt for any purchases
• At the completion of any training program to provide you with your certificate
• Shortly after the completion of any training program to ask for feedback
• To notify you that a completed training certificate is about to expire
• To notify you of any changes to our Terms of Service or Privacy Policy
• To notify you of legal changes that affect your training or certification
• To respond to Customer Service requests or other communication via Help@OFT.tv
• To notify you of a law enforcement request for your data
• To notify you of a data breach
• To notify users who sign up prior to a class going live that is now available
• To notify users that new training material is now available

Severability, waiver and interpretation

Unless as otherwise stated in the Terms, should any provision of the Terms be held invalid or unenforceable for any reason or to any extent, such invalidity or enforceability shall not in any manner affect or render invalid or unenforceable the remaining provisions of the Terms, and the application of that provision shall be enforced to the extent permitted by law.

Any failure by Streaming Media Management LLC or any third party beneficiary to enforce the Terms or any provision thereof shall not waive Streaming Media Management LLC’s or the applicable third party beneficiary’s right to do so.

As used in these Terms, the words “include” and “including,” and variations thereof, will be deemed to be followed by the words "without limitation."

Indemnification

You agree to indemnify and hold Streaming Media Management LLC harmless from and against all damages, losses, and expenses of any kind (including reasonable attorney fees and costs) arising out of or related to your breach of the Terms or any one of them; and your violation of any law or the rights of a third party.
